These Terms and Conditions govern the rights and obligations regarding the use of the FoodSHare platform. The FoodSHare platform is available at https://foodshare.foodscalehub.com/ (hereinafter: the Platform) and is a set of services related to the redistribution of surplus food provided by the ASSOCIATION FOR ENTREPRENEURSHIP AND INNOVATION "FOODSCALE HUB".
The Foodscale Hub allows you to use the Platform, in the manner and under the conditions described in these Terms and Conditions. These Terms and Conditions form an integral part of the Platform and represent the provisions of the contract concluded between:
1. FOODSCALE HUB (hereinafter referred to as the Organization).
2. Each individual user of the FoodSHare Platform (hereinafter the User).
By voluntarily using any segment of the Platform, the user confirms that he is familiar with and agrees to the Terms and Conditions.
The Organization undertakes to provide users with the services defined in these Terms and Conditions, in the manner described in these Terms and Conditions, and in accordance with the laws and regulations of the Republic of Serbia.
By accessing and using the Platform, users agree to the Terms and Conditions, thereby concluding an access agreement with the Organization as a service provider of a set of services related to the redistribution of surplus food. These Terms and Conditions apply to any access to the contents of the Platform. The User undertakes to comply with these Terms and Conditions when using the Platform.
The Contracting Parties agree that in order to fulfill the stated obligations, it is necessary for the Organization to collect, process and store personal data of users in accordance with the Privacy Policy and applicable laws and regulations of the Republic of Serbia. By accepting these Terms and Conditions each user confirms that he is familiar with and agrees with the Privacy Policy.
The platform is a place where food producers can offer surplus products to humanitarian organizations in the form of donations. The content of the platform consists of its own content and content created by users.
The users of the Platform's services are considered to be registered users, exclusively legal entities in the capacity of donors (organizations - food producers, distributors, farmers) and recipients of donations (humanitarian organizations), as well as natural persons in the capacity of volunteers. Registered users are legal entities (donors and recipients of donations) and natural persons (volunteers) who register and apply on the Platform. Using the Platform for registered users is completely free of charge.
To use the platform as a recipient and donor, it is necessary that the users are over 18 years old and represent a legal entity. Volunteers can be individuals, but they must be over 18 years old.
When registering, users register their email address, create a password and accept these Terms and Conditions. The user is responsible for secrecy and password protection. A user may open only one user account, unless otherwise permitted by the Organization. When using the Platform, the Organization may collect other data (IP address, access time, device type, location, etc.) in order to improve the user experience, prevent abuse or analysis.
If the user assesses that there has been abuse and unauthorized use of the user account, he is obliged to inform the Organization. The registered user can terminate his user account at any time, without the obligation of any explanation and notification. The user can close his account by clicking on the "My Profile" button, then on the "Personal Data" field and selecting the "Delete" option. By selecting this option, the user permanently deletes his account, of which he is informed.
Registered donors can post surplus food they want to donate, and recipients can apply to pick up donations. Volunteers can appear on the platform with the desire to help with the realization of the transport of the donation.
All content and information left by users on the Platform must be true and correct. The responsibility for the truthfulness and accuracy of the entered content lies solely with the users who entered the same content.
A registered donor may delete a donation if he or she has previously consulted with the Organization.
Any use of the Platform that is in violation of these Terms and Conditions shall be considered a violation of the Terms and Conditions and misuse of the services provided by the Organization.
The organization has the right to monitor all user activities on the Platform. If it notices any unauthorized activity or violation of these Terms and Conditions, it may take any technical or legal action it deems appropriate.
In addition to the above, illegal activities on the Platform are:
The Organization has the exclusive copyrights and intellectual property rights on the Platform, including all individual elements: textual, audio and video content, visual identity, program code, databases and other elements of the Platform where the author is the Organization. Any unauthorized use of the Platform or any element thereof without the written consent of the Organization as the holder of the exclusive copyright is considered an infringement of the copyright of the Organization.
The Platform may also contain elements on which exclusive copyrights and other intellectual property rights have other persons, who have sole responsibility for the content on which they are holders of these rights, regardless of whether the content is on the Platform of the Organization. The organization has sole responsibility for content that is copyrighted.
The User agrees that by posting content on the Platform, it becomes visible and accessible to other users in accordance with these Terms and Conditions. The User is solely responsible for the content that is his author's work, or for the content that is posted on the Platform.
Users use the Platform at their own risk. The User accepts that the Organization is not responsible for the activities of other users.
All content and information left by users on the Platform must be true and correct. The responsibility for the truthfulness and accuracy of the entered content lies solely with the users who entered the same content. The organization does not guarantee the truthfulness and accuracy of the content created by the users.
This liability provision applies to any damage that may occur as a result of errors and deficiencies, downtime, system failure, unauthorized access to data, activities that are contrary to these Terms and Conditions, etc. As a result of force majeure, technical problems or maintenance systems, the Platform may be temporarily unavailable or available to a limited extent.
The Organization provides a set of services related to the redistribution of food waste, so that it is not possible to make a complaint about the performed services of the Organization. The service provided by the Organization was fully performed because the provision of services began after the explicit prior consent of the user to use the service.
Applicable regulations of the Republic of Serbia apply to everything that is not regulated by these Terms and Conditions. In case of a possible dispute, the Organization and the user are obliged to try to resolve the dispute amicably, and if they fail to do so, they can resolve the dispute in court in the competent court in Belgrade.
The organization reserves the right to change the Terms and Conditions, whereby a new version will be published on the Platform and can be sent to registered users by email.
These Terms and Conditions take effect on the day of publication on the Platform.
